Unpaid Construction Payment Certificates: Claims in Dubai

A payment certificate states the sum the engineer or employer's representative considers due. Once issued, it is strong evidence of a debt. Non-payment of a certified amount is one of the clearest claims in construction.

What does a certificate prove?

That the certifier assessed the sum as due, and under many forms that the payment obligation has arisen. The employer may still raise set-off or defects, but it must show a proper basis. We prepare to meet both.

What if no certificate was issued?

Then the question is whether the engineer failed to certify and whether the employer's refusal was justified. The contract's payment timetable and deemed approval mechanisms matter.

What is the fastest practical route?

A formal notice of default and demand, followed by a claim for the certified sum. Interest may be available under the contract. See retention recovery.
