Can pay-when-paid be a defence?
Only if the subcontract contains it and its wording covers the situation. Some clauses delay payment, others make payment conditional. We analyse the exact words and the main contractor's own receipts.
What proves your entitlement?
Signed quantities, site records, interim applications, approvals by the main contractor, and any certificate from the employer's side. Keep site photos and daily reports. They carry weight.
What about set-off?
The main contractor must substantiate any deduction for defects, delay or back-charges. Challenge unsupported deductions in writing quickly. See contractor and subcontractor disputes.
