Construction Advance Payment Recovery in Dubai

An employer who paid an advance can claim it back if the contractor does not perform, or if the advance has not been recovered from later certificates. The advance payment guarantee is usually the lever.

How is an advance normally recovered?

By deduction from interim certificates on a set percentage. If the project stops early, the balance remains due and may be claimed or recovered under the guarantee.

What should a contractor check?

Reconcile the advance against work executed and certified. Check whether the claim for repayment is premature or overstated. Keep records of mobilisation costs and materials purchased.

What should an employer check?

The guarantee terms, expiry and demand requirements, and the contract's repayment trigger. A non-compliant demand can fail. See guarantee disputes.
