Defective Construction Work Claims in Dubai

A defect is work that does not meet the contract specification or the required standard. The employer can require rectification, deduct the cost or claim compensation, depending on the contract.

How do I preserve the evidence?

Photograph and record the defect with dates, notify in writing, and ask an engineer to inspect before any repair. Remedial work done first can destroy the proof.

Who must put it right?

The contractor, during the defects liability period and under its warranty obligations. If it fails, the employer may engage others and recover cost where the contract allows.

What compensation is realistic?

Cost of repair, reasonable consequential loss and sometimes diminution in value. Expert evidence will usually be needed. See defect liability.

The ten-year structural liability rule is stated in general terms. UAE civil legislation has been revised recently, so the exact provision and period are checked against the current text before we advise on a specific claim. This page is general information, not legal advice.
