Will the court enforce the agreed figure?
Often it will, but it is not automatic. The court may reduce the sum if it is excessive compared with the loss, and may reduce it to nothing where no loss was suffered. A contract term that tries to exclude this review is not reliable.
What should the claimant prove?
That a breach occurred, that the clause applies, and that some loss followed. Even a modest record of loss strengthens the claim. Without it, the party resisting can argue the clause should not bite.
How do I challenge a penalty?
Show what the other side actually lost, or that the breach was caused or contributed to by them. Cap and trigger wording matters too. For construction delay clauses see liquidated damages in construction.

Can a court increase an agreed figure?
The court may adjust it to match the actual loss. That can work in either direction, so a claimant should be ready with evidence.
Can the clause be a daily or weekly rate?
Yes, it is common. The cap and start date are usually the points in dispute.
